02/03/2012 - Information to review if you are considering applying to become licensed as an Assisted Living Community (ALC). An ALC is a personal care home that serves 25 or more residents and offers assisted living care to its residents. Assisted living care includes personal services, administration of medications by certified medication aides and assisted self-preservation for the residents of the community.

12/30/2011 - Notice to Applicants for Certificates, Permits, Registrations and Licenses. As a result of the passage of HB 87 (2011), the Healthcare Facility Regulation Division cannot issue a new license or certificate beginning January 1, 2012 unless the proper affidavit with a secure and verifiable document attached is on file with the Division. The new affidavit form can be found in the relevant application packet listed under forms and applications. The affidavit form has changed from the one previously required for some programs. Applicants must use the new affidavit form and attach a copy of a secure and verifiable document.
12/30/2011 - Notice to Certificate of Need Applicants. Effective January 1, 2012, as a result of the passage of HB 87 (2011), the Healthcare Facility Regulation Division cannot issue a Certificate of Need unless the proper affidavit with a secure and verifiable document attached is on file with the Division. 7/25/2011 - Rules and Regulations for Proxy Caregivers Used in Licensed Healthcare Facilities Effective August 7, 2011
NOTICE: Effective 10/21/2010, the annual activity fee has been suspended for X-Ray Machines (ONLY) until such time as the promulgation of revised Rules and Regulations for X-Ray Machines has been completed. Registrants will be notified when the annual activity fees for X-Ray Machines resume.

Our History
The Healthcare Facility Regulation Division is responsible for healthcare planning, licensing and certification of various healthcare facilities and businesses. The Division was created in 2009 as a result of the passage of two laws, HB 228 (2009) and SB 433 (2008). These laws transferred to the Department of Community Health functions previously performed by the Office of Regulatory Services. In 2011, the Division also became responsible for providing direction for the Certificate of Need program in recognition of the value of integrating the administration of health planning with healthcare regulation. The Division is directed by Brian Looby.
