- Federal law requires the employers of nurse aides to conduct background checks of nurse aides- both employees and contractors.
- The State of Georgia does not license or perform background checks on nurse aides.
- DCH does not license any health professionals.
- Nurse aides candidates who have completed an educational training course are listed on the registry website.
- The state does not perform back checks on these individuals.
- Employers have the responsibility to perform employee background checks as per federal law.
- The Georgia Medical Care Foundation approves CNA training courses that are provided by private entities across the state.
- The DHR Office of Regulatory Services Long Term Care Unit audits nursing home compliance with the federal law that requires employers to do background checks. Beginning in July, 2009 this function will move to DCH.
- The Medicaid program housed in DCH can and will recoup or decline payment to any long term care provider found not to be compliant with this federal law.
